These Terms & Conditions (“Terms”) govern your access to and use of www.arabesquepilates.com (the “Site”), the Arabesque Pilates mobile application (the “App”), any customer portals, booking or scheduling platforms operated on behalf of Arabesque Pilates (including but not limited to those powered by third-party providers), and all services, products, digital offerings, and content provided by Arabesque Pilates LLC (“Arabesque Pilates,” “we,” “us,” or “our”).

By accessing or using the Site, App, any associated platform or customer portal, or any related services—whether creating an account, scheduling services, purchasing products, or participating in any offering—you acknowledge that you have read, understood, and agree to be bound by these Terms.

Participation in classes, sessions, or services requires acceptance of the Arabesque Pilates Client Participation Agreement, Liability Waiver, Studio Policies, and Membership Terms.

Use of the Site, App, any associated platform, or any related services constitutes click-through acknowledgment of these Terms.

About the Website & Services

The Site, App, any associated platform, or any related services serve as e-commerce and informational platforms operated by Arabesque Pilates LLC for providing:

  • In-person Pilates classes, private sessions, and workshops

  • Virtual, livestream, and on-demand fitness services

  • Memberships, class packages, and single-session purchases

  • Gift cards

  • Retail merchandise, including but not limited to apparel, grip socks, branded Pilates equipment, accessories, and third-party wellness products

  • Educational content, announcements, and studio policies

Important: Use of the Site, App, any associated platform, or any related services does not create a medical, therapeutic, or healthcare-provider relationship.

Eligibility & Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. Accounts may not be assigned or transferred. Arabesque Pilates reserves the right to suspend or terminate accounts at its discretion, subject to applicable law.

Health, Medical & Fitness Disclaimers

All services and content are provided for general fitness and educational purposes only and do not constitute medical advice.

By using the Site, App, any associated platform, or any related services—or participating in services—you acknowledge that:

  • Physical exercise involves inherent risks

  • Participation may not be appropriate for all individuals

  • You are responsible for consulting a licensed healthcare provider before engaging in physical activity, especially if pregnant, injured, or managing a medical condition

  • No physician-patient or therapist-client relationship is created

Assumption of Risk

By purchasing services or participating in any class or session (in-person or virtual), you voluntarily assume all risks associated with physical activity, including but not limited to:

  • Muscle strain or joint injury

  • Falls, dizziness, or overexertion

  • Equipment malfunction or misuse

  • Injuries occurring during virtual participation outside the studio

Arabesque Pilates makes no guarantees of results from participation in services, classes, programs, or use of content. Individual results vary. Digital content and virtual services are provided as-is and for educational purposes only.

Virtual Classes & Digital Services

Virtual services are provided without physical supervision. Users are responsible for:

  • Ensuring adequate space and appropriate equipment

  • Assessing personal readiness for participation

  • Managing their physical environment

Technical disruptions, outages, or errors caused by third-party platforms do not create entitlement to refunds, except as described in Force Majeure.

E-Commerce, Payments & Billing

  • Payments are processed through secure third-party payment processors. Arabesque Pilates does not store full payment card information.

  • Pricing, availability, and offerings may change at any time.

  • Gift cards, memberships, packages, and digital services may be non-refundable and non-transferable, except as described in Force Majeure or as required by law.

  • Any credits issued have defined expiration dates, as noted at the time of issuance.

Cancellation & Refund Policy

Unless otherwise required by law:

  • All sales are final

  • Memberships, packages, gift cards, and digital services are non-refundable

  • Participation in studio services, memberships, and class bookings is subject to additional Studio Policies and Client Participation Agreements presented at the time of purchase or registration.

  • Digital content is non-refundable once accessed

Nothing in this section limits non-waivable consumer rights. Please refer to Force Majeure for potential discretionary refunds, credits, or service extensions.

Third-Party Platforms & Services

The Site, App, any associated platform, and any related services are powered in part by third-party platforms, including but not limited to:

  • Squarespace – website hosting, content management, payment processing, and advertising/analytics support

  • TeamUp Sports, Inc. (“TeamUp”) – scheduling, embedded booking, client account management, lead capture, communications, and e-commerce functionality, including but not limited to the Arabesque Pilates customer portal currently accessible at (https://goteamup.com/p/12531933-arabesque-pilates/)

  • Stripe – payment processing for credit and debit card transactions

  • GoCardless – ACH payment processing

  • Other payment platforms (e.g., Venmo, Cash App) – used for occasional or pop-up event payments

  • Google – including but not limited to Google Workspace, analytics, and related services

  • Nextiva – voice, messaging, and communications services

In addition to the platforms listed above, Arabesque Pilates may use other third-party tools, integrations, and digital services to support scheduling, communication, marketing, payments, virtual experiences, and overall client care.Some third-party platforms, including Squarespace, may use cookies, performance monitoring, analytics, and related tools to improve functionality, manage services, and support marketing activities. While we make thoughtful efforts to select partners that align with our values, we cannot guarantee the accessibility or performance of all third-party services. These third-party platforms operate independently and maintain their own terms of service, privacy policies, and accessibility practices. Arabesque Pilates:

  • Does not own, control, or operate the underlying third-party technology or infrastructure

  • Is not responsible for outages, service interruptions, errors, data practices, security failures, or performance issues caused by third-party platforms or their sub-processors

  • Disclaims liability for any loss or disruption arising from reliance on third-party platforms and services

  • Requires users to acknowledge and assume the risks associated with the use of such third-party services

Use of the Site, App, any associated platform, or any related services constitutes acknowledgement of these Terms and the applicable third-party terms and policies.

Privacy & Data Use

Your use of the Site, App, any associated platform, or any related services is subject to our Privacy Policy, including but not limited to Squarespace’s Privacy Policy, TeamUp’s Privacy Policy, Stripe’s and GoCardless’ privacy and security policies, and other applicable third-party policies, which explain how personal information is collected, used, shared, and protected.

Arabesque Pilates complies with applicable privacy laws, including but not limited to:

  • GDPR (EU)

  • CCPA/CPRA (California)

  • Other local privacy legislation

Users may have rights to access, correct, delete, or restrict their personal information. Additional consent mechanisms may be implemented depending on jurisdiction. Users are responsible for compliance with applicable local privacy laws.

The Site, App, any associated platform, or any related services may use cookies, tracking, analytics, and advertising tools provided by Squarespace, TeamUp, Google, or other third-party service providers to improve functionality, user experience, and deliver marketing content. Personal data collected via TeamUp embedded lead capture forms is also subject to these Terms and Privacy Policies.

Personal information may also be processed by third-party service providers, including but not limited to Stripe, GoCardless, Google, and Nextiva, in accordance with their respective privacy policies and this Privacy Policy.

Electronic Communications

By using the Site, App, any associated platform, or any related services, you consent to receive electronic communications.Electronic notices satisfy legal writing requirements. Communications may be delivered through email, voice, or SMS services.Electronic communications may be delivered through third-party services, including but not limited to Google, Nextiva, Stripe, and GoCardless. Google and Nextiva may be used for analytics, messaging, and support communications, while Stripe and GoCardless may send payment-related notices, such as receipts or confirmations. Users may opt out of non-essential or promotional communications as described in the Privacy Policy.

Intellectual Property & Software License

All content on the Site, App, any associated platform, or any related services is owned by or licensed to Arabesque Pilates. Third-party software, trademarks, copyrights, and technology are owned by their respective providers.

  • You may not reproduce, distribute, modify, or exploit any Arabesque Pilates content without express written permission.

  • The App is licensed, not sold, and may not be reverse-engineered, copied, or redistributed.

Software License (EULA):

You are granted a limited, non-exclusive, non-transferable license to access, download, install, and use the Site, App, any associated platform, or any related services for personal fitness purposes.

You may not:

  • Copy, modify, reproduce, distribute, sell, lease, or sublicense the App

  • Reverse engineer, decompile, or extract source code, except as allowed by law

  • Remove or obscure proprietary notices or trademarks

  • Use the App for purposes other than authorized

User-Generated Content

If users provide reviews, photos, or comments, you grant Arabesque Pilates a non-exclusive, royalty-free, worldwide license to use such content. Content must comply with applicable laws. Offensive, illegal, or infringing content is prohibited.

Children’s Use

Arabesque Pilates does not knowingly collect information from children under 13. Users under 18 must have parental or guardian consent. Arabesque Pilates may request documentation for parental consent.

California Consumer Notice

California residents may opt out of arbitration within 30 days of first accepting these Terms by submitting written notice including name, email, and intent to opt out. Complaints may be filed with the California Department of Consumer Affairs. These Terms respect rights under CLRA, UCL, and California Automatic Renewal Law.

International Users

The Site, App, any associated platform, or any related services are operated from the United States. If you access or use the Site or App from outside the United States, you do so at your own initiative and are responsible for compliance with applicable local laws.

Personal information collected from international users may be transferred to, stored, and processed in the United States or other countries by Arabesque Pilates and its third-party service providers, including but not limited to Squarespace, TeamUp Sports, Inc., Stripe, GoCardless, Google, and Nextiva, as well as their respective affiliates, vendors, and sub-processors.

Such transfers may involve jurisdictions that do not provide the same level of data protection as your country of residence. By accessing or using the Site, App, any associated platform, or any related services, creating an account, submitting personal information, or communicating with us electronically, you acknowledge and consent to the transfer, storage, and processing of your personal information in accordance with these Terms, our Privacy Policy, and the applicable third-party privacy policies.

Where required by law, Arabesque Pilates will implement appropriate safeguards to protect personal information transferred internationally.

Indemnification

Users agree to indemnify and hold harmless Arabesque Pilates, including but not limited to its use of third-party platforms such as Squarespace, TeamUp, Stripe, GoCardless, Google, and Nextiva, from claims arising from use of the Site, App, any associated platform, or any related services, violation of these Terms, or violation of law.

Dispute Resolution & Arbitration

Disputes arising out of or relating to these Terms, your use of the Site, App, any associated platform, or any related services, or services provided by Arabesque Pilates shall be resolved through binding arbitration governed by the Federal Arbitration Act, except where prohibited by law. Arbitration will take place in New York. Courts in New York have exclusive jurisdiction for enforcement of arbitration awards. Class actions are waived to the fullest extent permitted by law.

California Residents: 30 days to opt out of arbitration; proper opt-out allows disputes to proceed in court.

Limitation of Liability & Liability Waiver

To the maximum extent permitted by law, Arabesque Pilates shall not be liable for indirect, incidental, or consequential damages arising from the use of the Site, App, any associated platform, or any related services, or any third-party platforms, including but not limited to Squarespace, TeamUp, Stripe, GoCardless, Google, and Nextiva. Users release Arabesque Pilates from liability except for gross negligence or willful misconduct.

Force Majeure

Arabesque Pilates shall not be liable for any failure, interruption, or delay in performing its obligations under this Agreement if such failure or delay is due to circumstances beyond its reasonable control. Such circumstances include, but are not limited to, acts of God, natural disasters, pandemics, government orders, labor disputes, power outages, cyberattacks, internet or telecommunications failures, equipment failures, or other unforeseen events.

In such events, Arabesque Pilates reserves the right to modify, suspend, or cancel Studio Activities, memberships, or services as reasonably necessary without liability. Discretionary refunds, credits, or service extensions may be provided at the sole discretion of Arabesque Pilates.

Emergency / Safety

Users must follow all studio safety rules and instructor guidance. Failure to comply may result in suspension or termination of access to classes or services.

Termination

Arabesque Pilates may terminate or suspend access at any time, including due to Force Majeure events. Termination does not create entitlement to refunds or compensation outside Force Majeure provisions.

Taxes and International Fees

Users are responsible for applicable taxes, duties, or currency conversion fees associated with purchases.

Future Technology & Services

Arabesque Pilates may introduce new features, services, or apps. Use of these features is subject to these Terms unless otherwise specified.

Governing Law & Severability

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.

Provisions relating to disclaimers, limitations of liability, indemnification, privacy, intellectual property, dispute resolution, and any other provisions that by their nature should survive termination shall survive the termination or expiration of these Terms.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

Changes to Terms

We may update these Terms at any time, with or without notice. Updates are effective upon posting. Continued use of the Site, App, any associated platform, or any related services after updates are posted constitutes acknowledgment of the revised Terms. These Terms are a part of and incorporated into the Arabesque Pilates Client Participation Agreement, Liability Waiver, Studio Policies, and Membership Terms. In the event of any conflict, the Arabesque Pilates Client Participation Agreement, Liability Waiver, Studio Policies, and Membership Terms shall control.
